Probate

There are few words in the English language that create as much fear and apprehension as the word “probate”. Perhaps only “shark” or “audit” have stronger negative connotations.

In reality, probate is simply a court proceeding to transfer legal title of a decedent’s assets to his/her heirs. Probate is necessary to: (i) determine if the decedent had a will; (ii) pay or resolve the decedent’s debts and final expenses; and (iii) distribute the decedent’s remaining assets to his/her heirs. Probate can be a very simple process; however, there are two (2) things that can derail a smooth probate proceeding: (i) extensive creditor claims against the estate; or (ii) disputes between or among the heirs as to the distribution of the estate’s assets.
